PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India seeking the issuance of a Writ of Mandamus directing the 3rd respondent to consider and dispose of the appeal dated 15.05.2026 preferred by the petitioner challenging the rejection order dated 02.05.2026 in Application ID. No.2026/0103/08/018369 passed by the 5th respondent within a stipulated time as fixed by this Court.

ORDER

The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the 3rd respondent to consider and dispose of the appeal dated 15.05.2026 preferred by the petitioner challenging the rejection order dated 02.05.2026 in Application ID. No.2026/0103/08/018369 passed by the 5th respondent within a stipulated time as fixed by this Court.

The case of the petitioner is that the property measuring a total extent of 4.78 acres comprised in Survey No. 53/3, Lakkampatti Village, Mettur Taluk, Salem District was originally owned by one Gurunathan, who demised on 15.07.2002. Subsequently, his legal heirs sold a portion of the property to an extent of 2.34 1⁄2 acre out of 4.78 acre to one Mahalingam under a registered sale

deed dated 04.10.2021. The said Mahalingam, in turn, sold a portion measuring 1.15 acres (out of 2.341⁄2 acres) to one C. Govindaraj vide a registered sale deed dated 06.03.2023, and his remaining portion measuring 1.191⁄2 acres to one Murugesan. The legal heirs of the deceased Gurunathan sold the remaining extent of 2.341⁄2 acres to one C.Amsa.

3. Thereafter, the petitioner purchased the respective portions from the said Govindaraj, Murugesan, and Amsa. Based on these valid title documents, the petitioner applied for a patta transfer before the revenue authorities. However, the 5th respondent rejected the application. Aggrieved by the rejection, the petitioner preferred a statutory appeal before the 3rd respondent, which remains pending. Hence, the petitioner has approached this Court seeking a direction for the consideration of his patta transfer request and consequential reliefs.

4. Heard the learned counsel appearing for the petitioner and the learned Government Counsel appearing for the respondents.

5. Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the appeal, directs the 3rd respondent/Revenue Divisional Officer to consider the petitioner's appeal dated 15.05.2026 and pass appropriate orders, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
