ORDER

Pursuant to the order of this Court dated 07.11.2025, the Secretary to the Government, Secretary to Human Resources Department was suo motu impleaded as respondent.

2.The 1st and 2nd respondents filed a status report before this Court on 5.12.2025. By the aforesaid report it is stated that pursuant to the order of this Court in W.P.No.2621 of 2023 dated 19.09.2023, necessary amendments were issued to Tamil Nadu Civil Service (Appointment on Compassionate grounds) Rules, 2023, vide G.O.(Ms.)No.41, Human Resource Management (G) Department dated 04.08.2025 and the same was published in the Tamil Nadu Government Gazette, dated 04.08.2025.

3.By the aforesaid report it is also stated that a new Rule vide Rule 13-A has also been inserted in the Tamil Nadu Civil Services (Appointment on Compassionate Grounds) Rules, 2023 (herein after referred as "Rules") with regard to the maintenance of State-wide seniority, that the Government has created a web portal, namely www.tncgap.tn.gov.in referred to in Rule 13-A of the Rules and made the same operational and notified with effect from 31.10.2025. The report further depicts that as on 04.12.2025, around 6694 pending applications have been uploaded, 242 applications are in draft stage for Page No.2/5

want of certain details from the applicants and various appointing authorities are in the process of uploading the remaining applications. 4.Learned Additional Advocate General appearing on behalf of the respondents submitted that as on date while this Court is taking up the matter, 7036 applications have been uploaded and 196 are in draft stage which are pending for want of certain details from the applicants. 5.Learned Additional Advocate General further submitted that since the Government had made the web portal operational containing several details, the applicants are required to submit like the date of death of the ex-employees for assigning seniority for compassionate appointment, going forward, if any applicant submits application online, the same would be captured automatically without there being any requirement for the respondent department to upload the document.

6. The learned Additional Advocate General thus submits that the respondents have complied with the order of this Court in letter and spirit. 7.In order to demonstrate the steps taken, officials of the Human Resources Management Department, along with the IT personnel, present in Page No.3/5

this Court showed the functionality of the web portal and the security measures that have been put in place so that the data entered into the portal is not hacked or altered by any hackers and is secured.

8.Having satisfied with the steps taken by the Human Resources Management Department and also taking note of the fact that the respondents have already uploaded more than 7,000 applications out of 8,000 applications received by them, and since the learned Additional Advocate General assures this Court that the remaining applications would also be uploaded in a week's time, this Court is of the view that the respondents have complied with the order and no further orders are required.
