Respondents Prayer: Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, directing the first respondent to dispose of the stay application in the appeal No.C.No.4967745/G/2023 dated 13.06.2023 filed against the award dated 23.08.2021 in A.R.C.No.34/2020 on the file of second respondent. ORDER

The writ petition is filed seeking a direction against the first respondent to dispose of the stay application in Appeal No.C.No.4967745/G/2023 dated 13.06.2023, filed against the award dated 23.08.2021 in A.R.C.No.34/2020 on the file of second respondent.

2. The petitioner filed an appeal before the first respondent as against the order passed by the second respondent along with an interim application for stay. However, the same is pending on the file of the first respondent without passing an order in the interim application.

3. In view of the above facts and circumstances, the first respondent is directed to dispose of the interim application seeking stay in the main appeal within a period of four weeks from the date of receipt of a copy of this order. Thereafter, the first respondent is directed to dispose of the main appeal itself within a period of twelve weeks thereafter.

4. The writ petition, accordingly, stands disposed of. There shall be no order as to costs. Consequently, W.M.P.No.22699 of 2024 is closed.
