Mr.G.DJEARANY, Government Advocate (Pondy) Order The petitioner, who was arrested and remanded to judicial custody on 05.05.2026, for the alleged offences under Sections 194 @ 105, 238 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023, in Crime No.105 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that, the petitioner, along with other accused have assaulted the deceased/victim, who was stated to be under intoxication at the relevant point of time. During the alleged occurrence, the deceased sustained injuries and subsequently succumbed to the same while undergoing treatment. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in judicial custody since 05.05.2026 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail.
4. The learned Government Advocate (Pondy) appearing for the respondent reiterated the prosecution case and, on instructions, submitted that the victim in the present case succumbed to the injuries sustained during the occurrence and that the investigation is still pending. Hence, she vehemently opposed the grant of bail to the petitioner.
5. From the submissions made by the learned Government Advocate (Pondy), it is seen that the victim in the present case died as a consequence of the injuries sustained in the occurrence, which indicates disregard for the law. Considering the serious allegation against the petitioner, this Court is of the
view that this is not an appropriate stage to enlarge the petitioner on bail. Hence, this Court is not inclined to grant bail to the petitioner.
