Earlier, this Court by an order dated 22.11.2022 condoned the delay of 836 days on condition that the petitioner shall pay a sum of Rs.10,000/- to the respondent within a period of four weeks. Today, when the matter taken up for hearing, Mr.K.A.Mariappan, learned counsel for petitioner would submit that he has already filed an affidavit for complying the order of this court at an earlier occasion with regard to payment of Rs.10,000/-.

2. Submissions of the Petitioner is recorded. Registry is directed to number the appeal suit if it is otherwise found to be in order. Issue notice to the respondent through court returnable by 24.03.2023. Private notice is also permitted.
