..Respondents PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to pay interest of 12 percent to the petitioner for belated payment of Gratuity , Leave Salary, Provident fund and commutation of pension amounts and 10 days salary with effect from 21.10.2024 to 31.10.2024 , 21.02.2025 to 28.02.2025 , 21.05.2025 to 31.05.2025 , 21.06.2025 to 30.06.2025 , 21.07.2025 to 31.07.2025 within a time frame.

ORDER

This writ petition is filed for the following relief: "directing the respondents to pay interest of 12 percent to the petitioner for belated payment of Gratuity , Leave Salary, Provident fund and commutation of pension amounts and 10 days salary with effect from 21.10.2024 to 31.10.2024 , 21.02.2025 to 28.02.2025 , 21.05.2025 to 31.05.2025 , 21.06.2025 to 30.06.2025 , 21.07.2025 to 31.07.2025 within a time frame."

2. Heard the learned counsels appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. It is the case of the petitioners that they joined the service of the first respondent Corporation and retired from service during the years 2024-2025. However, the terminal benefits have been settled only after 6 to 22 months and also that the salary for 10 days were not paid to the petitioners. Therefore, the petitioners sent a representations which evoked no response so far. Hence, the present Writ Petition has been filed claiming 12% interest for the belated payment of retirement benefits such as Gratuity Leave salary, Provident fund and commutation of pension

amounts and to pay the salary as stated supra.

In view of the limited request made by the petitioners with regard to interest on the belated settlement of retirement benefits such as Gratuity, Leave salary, Provident fund and commutation of pension amounts, this Court directs the respondents to pay interest at the rate of 6% p.a. for the belated payment of retirement benefits from the date of retirement to till the date of actual disbursal of the retirement benefits of the petitioners and also to consider the issue in regard to disbursement of the salary as stated supra, if there is no other impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.

5. Accordingly, this Writ Petition is disposed of. Consequently, the connected miscellaneous petition is ordered. No costs. 29-06-2026 Index: Yes/No Speaking/Non-speaking order ssa
