..Respondent(s) PRAYER: This criminal original petition filed under Section 528 of BNSS, to direct the 1st and 2nd respondent to execute the Non-Bailable Warrant dated 1605-2026 against the 3rd respondent in M.P. No.428/2025 in M.C. No.615/2024 pending on the file of Learned II Additional Principal Judge, Family Court Chennai and pass any other order as deem fit under the circumstances of the case and thus render justice.

ORDER

This criminal original petition has been filed to direct the 1st and 2nd respondent to execute the Non-Bailable Warrant dated 16-05-2026 against the 3rd respondent in M.P. No.428/2025 in M.C. No.615/2024 pending on the file of Learned II Additional Principal Judge, Family Court Chennai.

2. It is seen that this is a maintenance case filed in M.C.No.615 of 2024 before the II Additional Principal Judge, Family Court, Chennai. In the family court proceedings dated 16.06.2026, it has been recorded that the instructions have been issued to execute the non bailable warrant through the Commissioner of Police, Chennai City and to await its execution, the case has been adjourned to 24.07.2026.

3.The learned Govt. Advocate (Crl.Side) appearing for the 1st and 2nd respondents submitted that though the petitioners claim that a Non bailable warrant has been issued to the 3rd respondent, as per the postal records, the respondent police have not so far received the same. As and when non bailable warrant is received, the same would be executed without delay.

Recording the above submissions, this criminal original petition is dismissed and it is also to be mentioned that already the family Court issued appropriate direction to the Commissioner of Police, Chennai City for execution of non-bailable warrant.
