Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, calling for records relating to the impugned order of the 1st respondent made in F.No.SRCAPP74/B.Ed/TN/2013-2014/53591 dated 11.9.2013, to quash the same and consequently direct the respondents to consider the claim of the petitioner for grant of recognition forthwith for B.Ed one year course. O R D E R
The writ petition has been filed to quash the order passed by the 1st respondent dated 11.9.2013 and to direct the respondents to grant recognition forthwith for B.Ed one year course.
2.When the matter was taken up for consideration, the learned counsel for the petitioner submitted that the petitioner would be satisfied if they are permitted to submit a fresh application before the authorities concerned, seeking recognition and on such submission, the authorities concerned may be directed to dispose of the same.
3.The learned counsel for the respective respondents have no serious objection in granting such relief to the petitioner. 4.Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court permits the petitioner to submit a fresh application enclosing all the required documents along with the copy of this order to the authorities concerned within a period of two weeks from the date of receipt of a copy of this order. On such submission, the authorities concerned shall consider the said application and pass appropriate orders on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner, within a period of six weeks thereafter.
