Crl.O.P.No.16557 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely M.Magesh, who was arrested and remanded to judicial custody on 06.07.2023 for the offences punishable under Sections 294(b), 323, 324, 506(2) and 307 of IPC in Crime No.145 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in this case. Petitioner is in Judicial Custody from 06.07.2023. Thus, he seeks bail to the petitioner.

3. In response, learned Government Advocate (Crl. Side) submitted that, defacto complainant was working under one Selvakumar in Ragavendra Juice Shop. On 26.05.2023 at about 12.30 a.m.,one person was speaking in an abusive language. When defacto complainant along with one Karthik questioned him, as to why he was speaking like that, there arose a wordy quarrel. Thereafter, at about 02.45.a.m., he came with two persons and attacked the defacto complainant and others 1/3

using sharp knife. As a result, two persons were injured. He further submitted that, apart from this case, there is one previous case pending against the petitioner. Hence, he opposed for grant of bail to the petitioner.

4. Considering the gravity of the offence alleged to have been committed by the petitioner and there is one previous case pending against the petitioner and also the fact that investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original petition is dismissed. 26.07.2023 Sma 2/3
