ORDER : The Court Made the following order :- The petitioner, who was arrested on 01.08.2021 and remanded to judicial custody for the alleged offences punishable under Sections 294(b), 417, 376 and 506(i) of IPC in Crime No.12 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner and the victim girl are lovers. Further, the petitioner had false promised to marry the victim girl and sexual intercourse with her and as a result, she became pregnant. Thereafter, the petitioner by giving tablets aborted her fetus. Further, the petitioner had refused to marry the victim girl and threatened her with dire consequences. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is in no way connected with the alleged offences by the prosecution and he has been falsely implicated in this case. He further submitted that he has been in jail from 01.08.2021. Hence he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the petitioner had sexual intercourse with her and thereafter, he refused to marry her. He further submitted that there is serious allegations made against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that there is serious allegation made against the petitioner and considering the gravity of offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
