ORDER

The writ petition has been filed to direct the 3 rd respondent to implement the order of the 1 st respondent dated 13.03.2025 and disburse the service benefits of petitioner's father Late Thiru.K.Suresh to the petitioner. Additionally, petitioner seeks a direction for appointment in a suitable post on compassionate grounds due to the death of his father.

The learned counsel for the petitioner would submit that the petitioner's father was serving as a Junior Assistant in the 3 rd respondent / Udhagamandalam Municipality, but he was dismissed from service on 24.05.2016. Aggrieved by the said dismissal order, the petitioner's father preferred an appeal on 10.08.2016. However, during the pendency of the appeal, the petitioner's father passed away on 15.10.2016.

It is the further submission of the petitioner that he preferred a writ petition in W.P.No.6817 of 2024, wherein this Court has permitted the petitioner to pursue his father's appeal vide order dated 14.03.2024. In pursuance thereof the petitioner has given an explanation to the respondent on 23.10.2024, and ultimately, the authorities passed an order on 13.03.2025, setting aside the order of dismissal of the petitioner's father. However, it is the contention of the petitioner that inspite of passing such an order on 14.03.2025, his father's terminal benefits have not been settled. Hence, the petitioner is constrained to file the present writ petition.

4. The learned Special Government Pleader appearing on behalf of the respondents would submit that they will examine the matter and settle the terminal benefits, if any, within a reasonable time.

5. In such view of the matter, this Court deems it appropriate to direct the respondents to settle the eligible terminal benefits of the petitioner's father, Page No.3 of 6

within period of twelve (12) weeks from the date of receipt of a copy of this order in accordance with law.

6. With the above directions, this Writ Petition stands disposed of. No costs.
