This Civil Miscellaneous Petition has been filed seeking to set aside the order dated 13.08.2020 dismissing the above Civil Revision Petition for non-prosecution.
2. Mr.K.S.Ilangovan, learned counsel for revision petitioner submitted that during the covid-19 pandemic period, the petitioner's counsel did not notice the listing of case. Thereafter, he noticed that it was dismissed for default, and filed the petition to restore the C.R.P. within time. Hence, he prayed that this petition may be allowed.
4. Mr.K.P.Joheeswaran, learned counsel appearing for respondent appeared and submitted that he has no objection for allowing this petition.
5. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition, this Court is inclined to allow this petition and to restore the Civil Revision Petition.
