The petitioner, who was arrested on 16.08.2016 for the alleged offences punishable under Sections 341, 294(b) and 307 I.P.C., in Crime No.358 of 2016, on the file of the respondent police, seeks bail.
2. Learned counsel for the petitioner submitted that the victim in this case has not sustained any injury and that petitioner has been falsely implicated in the case and he is in custody from 16.08.2016.
3. Learned Government Advocate (Crl.
Side) admitted the fact that the victim has not sustained any injury. He further submitted that investigation is pending in this case and hence, opposed for grant of bail to the petitioner.
4. Considering the fact that the victim has not sustained injury in this case and that the petitioner is in custody from 16.08.2016, this Court is constrained to release the petitioner on bail.
5. Accordingly, it is ordered that the petitioner shall be released on bail, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Ponneri, and on further condition that petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
