O R D E R
This writ petition is filed for the following relief: "To call for the records culminating in the impugned order bearing reference number Ka.No.U.MI.PO/E&PA/VEERAPANDI/VAA/KO.KATTU/A. No.
/2024 dated 02.01.2025 passed by the 3rd respondent and quash the same and consequently direct the respondents to provide electricity connection to install electric motor for the bore well in Survey No.128/10B2B1 within a stipulated period"
2. The factual matrix of the case as follows.
3. The total extent of lands comprised in S.No.128/10B2 was subdivided into S.Nos.128/10B2A, 128/10B2B1 and 128/10B2C. The petitioner's father was in possession of the land in S.No.128/10B2B1 measuring 2 Ares (5 cents). On 11.11.2005, the petitioner's father had 3/9
applied for 5 HP electricity connection to the 3rd respondent for fixing motor pump to draw water from bore well situate in S.No.128/10B2 i.e., S.No.128/10B2B1, for agricultural purpose and an application was registered in No.427 on 11.11.2025.

The petitioner would submit that his father passed away on 03.09.2014, leaving behind him surviving legal heirs, which included the petitioner and the petitioner has been continuing agricultural activities in the said land. The petitioner thereafter received an intimation dated 27.12.2021, from the 3rd respondent addressed to the petitioner's father pertaining to the electricity connection applied by his father on 11.11.2005 and it was stated that the same was taken up for consideration and the petitioner's father was directed to submit the land documents, FMB sketch of the land and other documents such as NOCs.
5. On 28.06.2022, the petitioner had purchased the entire extent of land in S.Nos.12/6A, 23/7A, 23/6C and 128/10B2B1, from other legal heirs under a registered sale deed and a patta was also mutated in 4/9
the name of the petitioner in patta No.5117, in respect of the land in which bore well is situate.
6. The petitioner had thereafter submitted all these documents to the 3rd respondent and sought for the electricity connection. Since the application for service connection was not considered, the petitioner had sent a representation on 06.11.2024 and as that was not taken up for consideration, he had filed WP.No.38272 of 2024, for a mandamus to the respondents to consider and pass orders on his representation dated 06.11.2024. This Court, by order dated 20.12.2024, directed the respondents to consider the representation and pass orders within a period of 12 weeks.
7. The order clearly directed the respondents to pass orders after hearing the petitioner. However, without hearing the petitioner the impugned order came to be passed.
8. Challenging the same, the petitioner is before this Court. 5/9
9. Heard the learned counsels on either side and perused the records.
10. This Court in WP.No.38272 of 2024 had passed the following order:
"5.Be that as it may, the petitioner only seeks a direction to respondents to consider his representation, therefore, without expressing any opinion on the merits of the claim made by the petitioner, the 4th respondent is directed to consider the representation of the petitioner dated 06.11.2024 and pass final orders on its own merits and in accordance with law, within a period of twelve weeks from the date of receipt of copy of this order, after issuing necessary notice to the petitioner."
The very order clearly directed the respondents to pass orders after issuing notice to the petitioner and hearing him.
11. Further, a mere perusal of the impugned order would clearly demonstrates that the petitioner has not been heard before passing the 6/9
impugned order. Therefore, without traversing into merits of the case, it would suffice that the impugned order be set aside as been contrary to the directions of this Court. The impugned order is quashed and the matter is remitted back to the 3rd respondent to pass fresh orders after issuing notice to the petitioner and after affording him an opportunity of a personal hearing. The said exercise shall be completed within a period of 2 months from the date of receipt of a copy of this order.
12. With the above observation and direction, this writ petition is allowed. No costs.
