Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to direct the 1st respondent to permit the petitioner to participate in the auction without any financial limitation.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus to direct the 1st respondent to permit the petitioner to participate in the auction without any financial limitation.

2. The case of the petitioner is that the petitioner had issued an auction notice for online forward auction of Stainless Steel Coml. Quality Materials on 20.06.2019 for auction around 393.424 MT of Commercial Quality Stainless Steel Materials and he had participated in the online forward auction on 20.06.2019 and thereafter, the petitioner was made

known about the winning bids of auction, which was available on the website of the 2nd respondent, whereby he was surprised to note that he was not able to bid for more than Rs.10,00,000/- and the system was showing that his application was ''Rejected'' without any reason. Aggrieved by the same, the present petition is filed.

When the matter is taken up for hearing, the learned counsel appearing for the respondent submitted that the e-auction was conducted through internet, in which 8 bidders participated including the petitioner and all the materials were sold to successful bidders and hence nothing survives for further adjudication in this petition and the prayer sought for in the present petition become infructuous.

Considering the above facts and circumstances, this Court is of the opinion the petitioner without challenging the e-auction notice, and subsequent rejection order, filing the Writ Petition for Mandamus, is not sustainable and further as mentioned by the learned counsel for the respondent, the auction proceedings has already been over and all the materials sold to the successful bidder. Hence no further adjudication is required in this Writ Petition.

5. In the result, the Writ Petition is dismissed. No costs. Consequently connected miscellaneous petition is closed.
