2.S.Rajapandian ...Respondents Prayer : Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, praying to direct the 1st respondent to provide adequate police protection to the petitioner from the 2nd respondent and her parents and hooligans at her matrimonial home situated at No.34, Jothi Illam, Balaji Nagar, Mannivakkam Extension, Chennai -48, on the basis of the petitioner's complaint dated 21.09.2021.

O R D E R

When the matter is taken up today, the learned counsel for the petitioner would submit that this Court finding that it is a matrimonial dispute, by an order dated 29.11.2021 had referred the matter to Mediation Centre. Now, the matter has been compromised between the parties and they have also entered into the Joint Compromise Memo. The Joint Compromise Memo is extracted hereunder:-

''(a) The 2nd Respondent agree to withdraw the H.M.O.P.No.192 of 2021 pending on the file of the Sub Court, Tambaram.

(b) The petitioner agrees to withdraw Crl.O.P.No.20184 of 2021 pending before this Honourable High Court.

(C) Today both the petitioner and the 2nd Respondent agree to filed a petition for divorce by Mutual Consent Petition under Section 13-B of the Hindu Marriage Act 1955.

Before Sub Court at Poonamallee.

(d) Today (01.02.2022) the parties exchanged their articles, in good conditions detailed in the annexure except Jewels of Both Parties.

(e) Along with the compromise memo an annexure is attached which contains the list of articles to be exchanged between the parties except Jewels of Both parties.

(f) On 01.02.2022 the 2nd Respondent pays the Petitioner sum of Rs.50,000/- by way of Cash as a Part settlement.

(g) Both the Petitioner and the 2nd Respondent agree not to claim maintenance or alimony from each other for the past percent or future and they further agree to waive their right over the estate of the other.

(h) The Petitioner and 2nd Respondent agrees to exchange the remaining jewels at the time of recording evidence in mutual consent petition. At the time of Evidence, Petitioner agrees to return the 7 items (1 Thali Chain, 1 Thunai Chain, 3 Rings and Metti Set) to the 2nd Respondent and the 2nd Respondent agree to return 15 items (14 Bangles, 1 Chain) and 25,000/- Cash as a full and final settlement to the Petitioner.

The Petitioner and the 2nd Respondent agree that the application for mutual consent to be filed Before the Sub Court at Poonamallee or any other competent court shall be in consonance with this memo of compromise and shall not be deviated.''
