ORDER
[Order of the Court was made by R.SUBRAMANIAN.J] It has become an habit for litigants to approach this Court under Article 226 of the Constitution of India, complaining of violation of the approved plan or 2/5
construction without any approved plan, even in cases where there is an inter se civil dispute regarding the property. In the case on hand, it is the claim of the petitioner that the seventh respondent is putting up construction in the property belonging to the petitioner.
2. The learned counsel for the seventh respondent would submit that the suit in O.S.No.3586/2022 has already been filed by the petitioner against the seventh respondent before the City Civil Court, Chennai. The said fact has been burked in the affidavit filed in support of this writ petition.
3. We do not think the jurisdiction under Article 226 can be invoked to settle private disputes, though there is a statutory duty cast upon the official respondents to ensure that there is no development, either without approval or in violation of the approval granted.
