Prayer:

Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, Directing the respondents to make separate arrangements for appointment of staffs, space and other requirements for collection of empty bottles under the buy-back scheme and not to involve the existing employees who are working in the retail vending shops of TASMAC in any work pertaining to the empty bottle buy-back scheme award cost.

ORDER

This writ petition has been filed to direct the respondents to make separate arrangements for appointment of staffs, space and other requirements for collection of empty bottles under the buy-back scheme and not to involve the existing employees who are working in the retail vending shops of TASMAC in any work pertaining to the empty bottle 2/6

buy-back scheme award cost.

2. When the matter was taken up for hearing on 25.06.2025, it was submitted by the respondent that a Committee was constituted by the respondents to address the grievances of their employees and hence, all the grievances of the petitioner can be addressed before the said Committee. Further, he sought time to get appropriate written instructions with regard to the above submission.

3. Today, a counter was filed by the learned Standing counsel, wherein at paragraph No.6, it has been stated as follows:

6) It is further submitted that TASMAC has constituted the said Committee vide Proceeding No.R3/8849/2022 dated 10.01.2025, comprising 10 members to assess the existing workload and also to find a suitable solution to address the grievances of the shop personnel and also sought for a report. The trade unions are requested to address the grievances before the said Committee for appropriate consideration. As the Scheme is scheduled to be implemented state-wide by August, 3/6

2025, any challenges or operational difficulties faced by the employees post-implementation shall be reviewed by the said Committee, which shall thereafter place its recommendations before the Managing Director of TASMAC, the second respondent herein.

4. A reading of the above shows that the respondent/TASMAC had constituted a Committee, by virtue of proceedings No.R3/8849/2022 dated 10.01.2025, to address the grievance of their employees. A copy of the said proceedings was also placed before this Court.

5. Further, it has been submitted by the learned Standing counsel that all the grievances of the petitioner, including the grievance raised in this petition, can be addressed before the said Committee. When such being the case, this Court is of the considered view that the petitioner shall address all their grievances before the said Committee, which was constituted by TASMAC vide proceedings No.R3/8849/2022 dated 10.01.2025.
