S.Renuga v. The District Collector
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 20.06.2025
CORAM
THE HONOURABLE Mr.JUSTICE C.KUMARAPPAN and W.M.P.No.24716 of 2025 S.Renuga ... Petitioner Vs.
1. The District Collector, Villupuram, Villupuram District.
2. R.Sathiavanimuthu ... Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the entire records relating to the order made in Na. Ka.No.5138/2017/BE4 dated 30.05.2025 on the file of the first respondent and quash the same and consequently direct the first respondent to reinstate the petitioner into service with continuity of service and other attendant monetary and service benefits. For Petitioner : Mr.C.Munusamy For Respondents : Mr.N.Naveen Kumar Government Advocate (for R1) ***** 1/5
O R D E R
The instant writ petition has been filed challenging the order dated 30.05.2025 passed by the first respondent.
2. The learned counsel for the petitioner would submit that the impugned order of termination has been passed without giving any notice to the petitioner.
3. At this juncture, the learned Government Advocate appearing for the first respondent would vehemently submit that the impugned order is consequential one, and has been passed in pursuance of the order in W.P.No.19291 of 2017 dated 15.09.2022, wherein this Court has quashed the appointment order issued against the petitioner. He would also submit that they have given notice to the petitioner and they have also got an explanation from the petitioner, which has also been referred in the impugned order. Hence, there is no ground to interfere with the impugned order. 2/5
4. I have given my anxious consideration to the submissions made on either side.
5. The main objection putforth by the petitioner is that the Writ Appeal against the order of the Writ Petition in W.P.No.19291 of 2017 has been allowed by order dated 14.02.2025 passed by the Division Bench of this Court. However, he would fairly submit that the order in Writ Appeal has not interfered with the order in the Writ Petition.
6. In such circumstances, there is duty cast upon the authority concerned to comply with the direction of this Court passed in W.P.No.19291 of 2017 and they have rightly complied with the same through the impugned order dated 30.05.2025. In such view of the position, the petitioner's claim does not have any right to challenge the impugned order as the cancellation of her appointment itself has attained finality in the Writ Appeal. Therefore, this Court does not find any merit in the Writ Petition.

7. Accordingly, this Writ Petition is dismissed. Consequently, the connected Miscellaneous Petition is closed. No costs. 20.06.2025 kv Index : Yes/No Speaking order /Non Speaking Order To The District Collector, Villupuram, Villupuram District.
