The petitioner/accused, who was already in judicial custody in Central Prison, Coimbatore, in connection with Thadi Kombu P.S. Crime No.224 of 2022, was formally arrested and remanded to judicial custody on 09.07.2024 for the offence punishable under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act, in Crime No.487 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner while in custody in another case, formal arrest was made and he was remanded to judicial custody on 09.07.2024, for illegal possession of 45 Kgs of Ganja. Hence, the case.

3. The learned counsel for the petitioner would contend that the petitioner is an innocent and a false case has been foisted against him. Hence, he seeks bail.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner while in custody in another case, formal arrest was made and he was remanded to judicial custody on 09.07.2024, for illegal possession of 1/3

45Kgs of Ganja. The quantity involved in this case is commercial quantity and the contraband was seized from the house of the petitioner. Hence he opposed to grant bail to the petitioner.

Heard both side counsels and perused the materials available on record.

Considering the representation made on either side and considering the fact that the quantity of material involved in this case comes under the commercial quantity and also considering that contraband was recovered from the house of the petitioner, this Court decline to grant bail to the petitioner at this stage.
