Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to release the petitioner's pension and retirement gratuity in pursuant to the retirement order in Na.Ka.No.76/2015/H1 dated 30.06.2015 on the file of the 5th respondent based on the representation dated 01.10.2024 made by the petitioner. The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to release the petitioner's pension and retirement gratuity in pursuant to the retirement order in Na.Ka.No.76/2015/H1 dated 30.06.2015 on the file of the 5th respondent based on the representation dated 01.10.2024 made by the petitioner. 2/6
2. It is the contention of the learned counsel for the petitioner that the petitioner had retired from the service of the 5th respondent on 28.05.1998 as Sanitary worker, and made representation dated 01.10.2024 to the respondents seeking pension and gratuity and there was no response for the same.
3. The learned Government Advocate appearing for the 5th respondent would invite the attention of this Court, about the proposal sent by them to the Government.
4. At this juncture, the learned Special Government Pleader appearing for the 1st, 2nd and 4th respondents would fairly submits that they would consider the petitioner's representation within a reasonable time.
5. Heard the learned counsel for both sides and perused the materials available on record.
6. Though there is disputed facts between the parties, taking into consideration of the fact that the representation made by the petitioner is yet 3/6
to be considered, this Court without going into merits of the matter, deems it appropriate to direct the respondents to consider the petitioner's representation dated 01.10.2024 and pass order on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
7. In the result, this Writ Petition is disposed of with the above observations. No costs.
