Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the 1st respondent to execute the Bailable Warrant issued by the learned Fast Track Court No.I, Metropolitan Magistrate, Egmore, Chennai, in C.C.No.7428 of 2016, within a period specified by this Court. ORDER

This petition has been filed for a direction to the respondent police to execute Bailable Warrant issued by the Court below in C.C.No.7428 of 2016.

2. The petitioner is the complainant in a 138 complaint filed against the second respondent.

Since the second respondent was evading summons, the learned Magistrate issued a bailable warrant on 23.11.2017. The grievance of the petitioner is that this bailable warrant has not been executed till date by the first respondent.

3. Heard, the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the 1st respondent police.

4. Taking into consideration, the facts and circumstances of the case, there shall be a direction to the first respondent police to execute the bailable warrant issued on 23.11.2017, by the learned Fast Track Court No.I, Metropolitan Magistrate Court, Egmore, Chennai in C.C.No.7428 of 2016, within four weeks from the date of receipt of copy of this order and produce the second respondent before the Court below.

5 . This Criminal Original Petition is disposed of with the above direction.
