This petition is filed to condone the delay of 388 days in filing the above criminal revision.

2.This Court, on 22.08.2024, had passed the following order: "The above criminal miscellaneous petition is filed to condone the delay of 388 days in filing the criminal revision. 2.When the matter is taken up, learned counsel for the petitioner submitted that the petitioner is ready to deposit Rs.25,000/- to show his bona fides in pursuing the revision and that the delay may be condoned on such deposit. He would also submit that the petitioner may be granted two weeks time to make the said deposit.

3.Learned counsel for the respondent, who appeared through videoconferencing, submitted that if the sum of Rs.25,000/- is paid either directly to the respondent or deposited before the Trial Court, then the petitioner's request for condonation of delay may be considered.

4.Considering the submissions made on either side, the petitioner shall deposit the sum of Rs.25,000/- on or before 04.09.2024 before the Trial Court.

5.Post on 05.09.2024."

3.In continuation and conjunction to the earlier order passed by this 1/3

Court on 22.08.2024, today, the learned counsel for petitioner produced a copy of receipt bearing No.97073 dated 02.09.2024 confirming the payment of Rs.25,000/- before the Family Court, Ariyalur. 4.The learned counsel for respondent submits that in view of the above deposit, he has got no serious objection in condoning the delay. His only request is that the respondent may be permitted to withdraw the said amount of Rs.25,000/- 5.The learned counsel for petitioner has no objection for the respondent to receive the said amount.

6.In view of the above, the respondent is permitted to withdraw the amount of Rs.25,000/- paid by the petitioner, by filing appropriate petition before the Lower Court and the amount to be returned to the respondent without any further reference to the petitioner. 7.In view of the same, the delay stands condoned and the petition is ordered.
