O R D E R

This Criminal Original Petition has been filed to transfer the investigation in Crime No.594 of 2017 from the file of the 1st respondent to the file of the 2nd respondent.

2. Heard the learned counsel for the petitioner, the learned Government Advocate appearing for the respondents 1 and 2 and perused the materials placed on record.

3. The petitioner has filed Crl.MP.No.568 of 2017 before the XXIII Metropolitan Magistrate, Saidapet Chennai, under Section 156(3) Cr.P.C. and on the directions of the learned Magistrate, Abiramipuram Police have registered a case in Crime No.594 of 2017 on 03.05.2017 under Sections 409 and 420 I.P.C. While so, the petitioner has filed the present petition for transfer of investigation on the ground that the Police have not made any progress.

4. On a reading of the FIR, it is seen that the land in question is situated, at Thiruppathur, Vellore District and most of the transactions have taken place there. Under such circumstances, this Court is of the view that interest of Justice will be served, if the case is transferred to District Crime Branch, Vellore. Accordingly, this Court directs the Inspector of Police, Abiramipuram Police Station, to obtain necessary orders from the concerned Deputy Commissioner of Police and hand over the Case Diary in Crime No.594 of 2017 to the District Crime Branch, Vellore. The District Crime Branch, Vellore is directed to conduct a thorough investigation and either file a charge sheet or a closure report as the case may be, under due intimation to the de facto complainant.
