ORDER

This criminal original petition has been filed seeking protection from harassment at the hands of the police based on the complaint given by the third respondent.

2. The learned Government Advocate (Crl. Side) submits that due to dispute between two flat owners, viz., the petitioner and the third respondent, a complaint has been given by the third respondent alleging that the petitioner's tenant has been causing nuisance and on enquiry, it came to light that the petitioner's tenant has agreed to vacate the premises on 05.08.2024.

3. The learned counsel for the petitioner submitted that the third respondent, who is a defaulter in paying maintenance charges, tries to disturb the petitioner by giving a false complaint.

4. However, the learned counsel for the third respondent submitted that the petitioner has let out the residential premises for running a printing press, thereby causing disturbance to the inmates of the building.

5. The dispute between the owners of two dwelling units regarding payment of maintenance charges has been converted into a criminal complaint. The police have rightly enquired into the mater and closed it as a civil dispute. Hence, nothing survives for adjudication in this criminal original petition.
