The instant writ petition has been filed with a prayer for issuing a certiorarified Mandamus, to call for the entire records relating to the impugned order passed by the 1st respondent in his proceedings Na.Ka.No.73048/2017/Pa.Tho.1, dated 19.02.2018 and quash the same and consequently direct the respondents to disburse all attendant benefits to the petitioner from date of promotion post to the Assistant on 16.06.1997.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

3. The learned counsel for the petitioner would submit that his juniors are receiving more pay. Therefore, on par with his juniors, he is also entitled to the pay revision. However, upon reviewing the documents, it appears the petitioner was promoted as Junior Assistant on 16.05.1997. He made a representation for revision of seniority on 24.10.2017, to the 1st respondent, but his request was rejected on 19.02.2018. Now, we are in 2025, with a long 2/5

delay of 7 years. This delay has undoubtedly caused prejudice to the respondents, and furthermore, the delay set in laches against the claim. Apart from that, the petitioner cannot create a fresh cause of action based on the stale claim.

4. Hence, this Court do not find any merits in the present Writ Petition. Accordingly, this Writ Petition is dismissed. No costs. 23.06.2025 jas Index : Yes/No Speaking order /Non Speaking Order 3/5
