ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 306 of IPC in Crime No.134 of 2017 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner having love affair with the defacto complainant daughter by name Mariammal, who is aged about 19 years and by giving false promise of marriage, he had close intimacy with her.
3. The learned Government Advocate (Criminal Side) appearing for the respondent/State submitted that the petitioner is arrayed as A1 in the FIR, who had close intimacy with the deceased Mariammal and when the deceased Mariammal approached A2, the mother of the petitioner, scolded the deceased using unparliamentary words, due to which, the victim enable to suffer the humiliation committed suicide. The learned Government Advocate further submitted that the deceased committed suicide only because of the denial of the petitioner for marriage and filthy language used by the petitioner's mother. The learned Government Advocate also submitted that the investigation is still pending, because of the absconding of the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. It is observed that this is the third petition filed by the petitioner. However, considering the nature of the offence and non co-operation of the petitioner by absconding himself for investigation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
