C.M.P.Nos. 18562, 18563 and 18558 of in S.A.No.248 of 2004 G.ARUL MURUGAN , J., It is reported that in the Second Appeal, the second appellant died.
2.The above petitions have been filed to condone the delay of 5174 days in filing the petition to set aside abatement; to set aside the abatement and to bring on record the petitioners 7 to 10 herein as the legal representatives of the deceased second appellant.
3. The learned counsel for the respondents have no objection to allow these petitions.
4. Perused the affidavit in support of the petition and satisfied with the reasons stated therein. Accordingly, these CMPs are ordered as prayed for and delay is condoned.
5.Registry is directed to carry out the necessary amendment.
6. It is also submitted that the impleaded 4th respondent in the appeal died and the appellant is directed to take necessary steps.
