Respondent Prayer: The writ petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondent to consider the representation dated 13.03.2023 sent to the respondent by the petitioner and issue a fresh legal heir certificate of late Mr.Suresh Kumar with the names of legal heirs alive as on date, i.e., Ms.Madhumitha, Mrs.Alamelu and Mrs.Renuka Devi and consequently remove the names of the petitioner's daughter Nivedhitha (deceased), and the petitioner's father-in-law Mr.Natarajan (deceased) from the certificate. ORDER
By consent, this writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner is the widow of the late Suresh Kumar, who passed away on 26.12.2017. The respondent herein has issued a legal heir certificate that includes the name of the petitioner, her daughter, and her parents- in- law (the parents of the deceased Suresh Kumar) as his legal heirs. Now, the petitioner's father-inlaw, Natarajan, passed away on 02.12.2018, and one of her daughters, Nivedhitha, who was married to one Anishkumar also passed away on 30.05.2021.
3.It is in this circumstances, the petitioner now seeks modification of the earlier legal heir certificate issued for her husband, Suresh Kumar, to reflect the subsequent changes.
4.Mr.M.Bindran, the learned Additional Government Pleader takes notice for the 2/4
respondent.
5.The respondent is now directed to consider the petitioner's representation dated 13.03.2023 and pass appropriate orders, in accordance with law, within a period of eight (8) weeks from the date of receipt of an online copy or the date on which the order is hosted in the official website, whichever is earlier. 6.This Writ Petition stands disposed of accordingly with the above direction. No Costs.
