Application No.3976 of 2021 in C.S.No.488 of 2019 N.ANAND VENKATESH., J.

This application has been filed by the plaintiff seeking for the leave of this Court to file eighteen additional documents. The above application is opposed by the respondents/defendants.

2.Heard the learned counsel for the plaintiff and the learned counsel appearing on behalf of the defendants.

3.The ground on which the leave is sought for to file additional documents is explained at Paragraph Nos.4 and 5 of the affidavit filed in support of the application. A reading of the same shows that the applicant/plaintiff wants to bring in these additional documents in answer to the case set up by the defendants in the written statement. This right is provided to the plaintiff by virtue of Order XI (1)(1)(c)(ii) of C.P.C.

4.In view of the above, this application stands allowed and it goes without saying that the marking of these documents will be subject to the relevancy, admissibility and proof.
