ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus to direct the respondents to consider the petitioner's representation dated 21.02.2025 within a time frame fixed by this court.

It is submitted by the learned counsel for the petitioner that the petitioner's great grand father, grand father and his father has been in possession of the property measuring an extent of 2.025 hectares comprised in S.No.102, Panchapalli Village, Palacode Taluk, Namakkal District from the year 1960 till date. In Government revenue records, the above said land has been classified as 'Kalangkuthu Poramboke'. At present, petitioner has been cultivating the said land by planting mango tree saplings in the said property. Seeking to change the classification of land and assign patta in his favour, the petitioner filed a representation on 21.02.2025 before the 1st respondent. However, the said representation has not been considered so far by the 1st respondent. Aggrieved by the same, the petitioner has come before this Court. 2/6

4. At the outset, it was submitted by the learned Addl. Government Pleader for respondents that the representation dated 21.02.2025, made by petitioner would be considered and appropriate orders would be passed after putting the petitioner and other interested parties including rival claimants, if any, on notice and after affording them an opportunity of hearing, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the 1st respondent to consider the representation dated 21.02.2025 on its own merits and pass appropriate orders in accordance with law, after putting the petitioner and other interested parties including rival claimants, if any, on notice and after affording them an opportunity of hearing, within a period of twelve (12) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
