ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to respondents 3 to 8 are dispensed with. 2.The present writ petition is filed praying for a writ of mandamus to direct the 1st respondent to consider petitioner's appeal dated 19.03.2025 within a time frame to be fixed by this Court. 3.It is submitted by the learned counsel for petitioners that the property comprised in S.Nos.451/1, 451/2 and 451/3, measuring an extent of 46 2/3 cents is situated at Madhavaram Village. It is submitted that petitioner's father viz., Balaram Naicker filed a suit in O.S.No.437 of 2/6

1960 before the District Munsif Court, Poonamalli seeking partition among family members. A final decree was passed on 28.09.1966. Thereafter, on 07.04.1982, Kanniammal sold her share measuring an extent of 23 1/3 cents to Balram Naicker vide Sale Deed, registered as Document No.1606 of 1982 before the Sub Registrar Office, Sembiam. The above mentioned property belonged to petitioner's family since then. The said Balaram Naicker died on 10.09.2021. It is further submitted that petitioners filed an appeal dated 19.03.2025 seeking issuance of patta. However, the said appeal has not been considered by the respondents till date. Aggrieved by the same, the present writ petition has been filed. 4.At the outset, learned Additional Government Pleader for respondents would submit that they would consider and dispose of the appeal dated 19.03.2025 in accordance with law, within a time frame to be fixed by this Court.

5.In view thereof, the writ petition is disposed of with a direction to the 1st respondent to dispose of the appeal filed by the petitioner dated 19.03.2025, after affording reasonable opportunity of hearing to the petitioner, respondents 3 to 8 and any other interested parties/rival 3/6

claimants, if any, within a period of 3 months from the date of uploading of order. It is made clear that this Court has not expressed any views with regard to the merits of the appeal and it is open to the concerned respondent to consider the same on its own merits and in accordance with law. There shall be no order as to costs.
