This application has been filed to issue subpoena to the Manager, M/s.Balaji and Co, Auctioneer and Estate Agents having office at T5, Mahaveer Chambers, No.103, Nainiappa Naicken Street, Chennai 600 003to give evidence in respect of the auction held for the sale of the suit property.

2. The applicant who is the second plaintiff in the suit had earlier filed an application in A.No.3305 of 2024 to implead the witness who is now sought to be examined and to whom subpoena is sought to be issued. A learned Single Judge of this Court has disposed the said application granting liberty to examine the said individual as the witness to the proceedings. Now, this application had been filed.

3. The learned counsel for the respondents wanted time to file counter. But, it appears to be protracting the case. Let the auctioneer be examined and necessary questions and cross examination may be put up to the auctioneer.
