ORDER

This Application had been filed to grant leave to the applicants/plaintiffs to file the reply statement to the written statement filed by the defendant, pending disposal of the Suit.

2. Mr.K.V.Babu, learned counsel appearing for the applicant would submit that a reply statement to the written statement had become necessary in view of the averments made therein. Therefore, he prays this Court to accept the reply statement.

3. On the contrary, the learned counsel for the respondent/defendant would vehemently oppose the same. He would submit that the Suit itself had been belatedly filed and the present application to receive the reply statement would further delay the process. He would further submit that the issues were framed by this Court as early as on 06.03.2025 and the present application had been taken after framing of issues. Therefore, he prays this court to reject the application.

4. I have considered the submissions made by the learned counsels appearing on either side and perused the materials placed on record.

5. A reply statement is sought to be made only to certain averments in the written statement. No documents were sought to be further relied upon by the applicant. This Court is further of the view that receiving the reply statement would not even give arise to framing of additional issues and therefore, this Court is inclined to accept the reply statement for completion of pleadings.
