Joint Transport Commissioner ( Administration) Office of the Transport Commissioner, Chepauk, Chennai-5. ..Respondents PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus, to call for the records relating to the order of the third respondent herein passed in his Letter No.62802/R3/2007 dated 30.05.2008 and quash the same and consequently direct the second respondent herein to include the petitioner's name in the panel of Assistants fit for promotion as Superintendents drawn for the year 2007-2008 in the appropriate place with due seniority and direct the second respondent herein to promote the petitioner as Superintendent with effect from 18.06.2007, the date of promotion of his immediate junior with all consequential monetary and service benefits.

The petitioner prays to issue a Writ of Certiorarified Mandamus and to call for the records relating to the order of the third respondent herein passed in his Letter No.62802/R3/2007 dated 30.05.2008 and quash the same and consequently direct the second respondent herein to include the petitioner's name in the panel of Assistants fit for promotion as Superintendents drawn for the year 2007-2008 in the appropriate place with due seniority and direct the second https://hcservices.ecourts.gov.in/hcservices/

respondent herein to promote the petitioner as Superintendent with effect from 18.06.2007, the date of promotion of his immediate junior with all consequential monetary and service benefits.

2.When the matter is listed today the learned counsel for the petitioner made a submission that the matter has become Infructuous and he has also made an endorsement to that effect: "The petitioner has been promoted in next year panel. This W.P. May be closed as infrucuous.."

3. In view of the above statement and endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as having become infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
