PRAYER: Criminal Miscellaneous Petition is filed under Section 482 of Criminal Procedure Code praying to relax the condition imposed upon the petitioner to report before the Inspector of Police, Steel Plant Police Station, Salem daily at 10.30 a.m., until further orders and the petitioner shall not go near the house of the defacto complainant in Crl.O.P.No.17566 of 2020 dated 09.11.2020. O R D E R

(The case has been heard through video conference) This petition has been filed to relax the condition imposed upon the petitioner to report before the Inspector of Police, Steel Plant Police Station, Salem daily at 10.30 a.m., until further orders and the petitioner shall not go near the house of the defacto complainant in Crl.O.P.No.17566 of 2020 dated 09.11.2020.

2. The learned counsel for the petitioner would submit that the petitioner is the father of the main accused and that he had been appearing before the Inspector of Police, Steel Plant Police Station, Salem, for nine days, since he was unable to comply with the conditions regularly and hence, he seeks for relaxation of the condition.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is complying with the conditions for nine days only and thereafter he was unable to comply with the conditions regularly due to some health issues.

4. Considering the said submission, the condition imposed by this Court in Crl.O.P.No.17566 of 2020 dated 09.11.2020 is modified to the effect that the petitioner shall report before the respondent police everyday at 10.30 a.m until further orders.

5. With the above directions, this Criminal Miscellaneous Petition is ordered.
