(Order of the Court was made by K.K.SASIDHARAN,J.) The learned single Judge issued a mandamus directing the Education Department to grant promotion to the first respondent herein taking into account the vacancy for the panel year 2018.

2. The petitioner has come up with the contention that the panel year 2018 lapsed and therefore, the panel for the year as on 01.01.2019 was prepared wherein his name was shown at serial No.1. The petitioner was not a party to the Writ Petition. The panel was in existence even when the Writ Petition was allowed by the learned single Judge.

3. We therefore do see considerable force in the submission made on behalf of the petitioner that he is a necessary party and as such he should be permitted to file appeal.

4. We therefore grant leave.
