Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the second respondent to take appropriate action in pursuant to the letter issued in O.Mu.22211/2018/M1 dated 10.07.2018 on the file of the first respondent and to permit the petitioner villagers to conduct the yearly festival of Balayee Amman Temple situated at Kasthuripatti, Varatharajapuram Village, Senthamangalam Taluk, Namakkal District under the direct supervision of the respondents 1 to 5 in the every Tamil month of Aadi and Aavani. O R D E R

The petitioner has come up with this writ petition seeking a direction to the second respondent to take appropriate action pursuant to the letter issued in O.Mu.22211/2018/M1 dated 10.07.2018 by the first respondent and to permit the petitioner's villagers to conduct the yearly festival of Balayee Amman Temple situated at Kasthuripatti, Varatharajapuram Village, Senthamangalam Taluk, Namakkal District, under the direct supervision of the respondents 1 to 5. Since such request is not acceded to, the petitioner is before this Court by this writ petition.

2. When the matter is taken up for hearing, the learned counsel for the petitioner confines his prayer to have the yearly festival of the Temple conducted with the cooperation of all the people of the said village.

3. The learned Special Government Pleader appearing for the respondents, on notice, submitted that the HR & CE authorities would proceed to conduct the annual festival as claimed, but, before doing so, a meeting would be conducted inviting all the community people in the said Village and thereafter, the respondents would proceed in accordance with law.

4. The above submission made by the learned Special Government Pleader appearing for the respondents, is agreeable to the learned counsel for the petitioner as well as the learned counsel appearing for the respondent Nos.6 to 9. Under such circumstances, the respondent Nos.1,2,3 and 5, shall provide all necessary assistance to the fourth respondent to conduct the meeting after due notice to all the parties and thereafter, proceed further for having the festival celebrated. Such an exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.
