ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), r/w 20(b)(ii) (B) & 29(1) of NDPS Act, in Crime No.145 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that on 02.04.2026, when the respondent police were on routine surveillance, they found the petitioner in possession of 1.300 kilograms of Ganja. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence, prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) strongly objected to grant anticipatory bail to the petitioner. He would further submit that if the petitioner is granted anticipatory bail, he may abscond and commit similar offences in future as well.

5. From the submissions made by the learned Government Advocate (Crl.Side), it is amply clear that, if any anticipatory bail is granted, it would become an adverse impact upon the Society. Considering the interest of Society at large, this Court is not inclined to grant anticipatory bail to the petitioner.
