ORDER
This writ petition has been filed seeking to call for the records of the impugned order Proc. No.1217/A/2024 dated 21.03.2024 issued by the 3 rd respondent and quash the same and consequently direct the 2 nd respondent to reinstate the petitioner to the post of Sub-Registrar, Joint II Sub Registrar Office, Tindivanam, with all back wages.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.
3. The learned counsel for the petitioner would vehemently submit that even according to the respondent, the petitioner is not the ultimate responsibility
for uploading of false documents. However, with false imputation, a criminal case has been registered against this petitioner. It is the further submission of the petitioner that since March, 2024, no charge sheet or charge memorandum has been given. Therefore, prayed to interfere with the impugned proceedings.
4. However, the learned counsel for the respondents would vehemently contend that there is a serious charge against the petitioner and that they are in the process of issuing charge memorandum. He would further contend that there is no public interest involved in interfering the impugned proceedings.
5. I have given my anxious consideration to either side submissions.
6. While looking at the typed set of papers, apart from challenging the charge memorandum, it is seen that the petitioner has also given a representations on 20.10.2024 and 05.06.2025 and the said representations are yet to be considered by the respondents. As rightly contended by the learned counsel for the petitioner, the petitioner was kept under suspension for a period of more than one year, without initiating any disciplinary proceedings. Even the inaction on the part of the respondents in not considering the petitioner's representation dated 20.10.2024 must also be seen with all serious concern. However, without going into the merits of the matter, this Court deems it appropriate to direct the 2 nd respondent to consider the petitioner's representations dated 20.10.2024 and 05.06.2025 and pass orders on it's own
merits and in accordance with law, within a period of four(4) weeks from the date of receipt of a copy of this order. The petitioner is at liberty to submit any precedents before the respondent, however it should be within a period of seven(7) days from the date of receipt of a copy of this order.
7. In the result, this writ petition stands disposed of with the above directions. There shall be no order as to costs. Consequently connected WMPs are also closed.
