ORDER
(Order of the Court was made by V.BHARATHIDASAN, J.) The petitioner is the husband of one K.Suganya aged about 24 years. According to the petitioner, his wife Suganya has been found missing from 10.06.2016. Suspecting that the third respondent has abducted the detenue, he has filed a complaint before the second respondent police. Based on the complaint, a case has been registered in Cr.No.523 of 2016 on 23.06.2016. Despite the registration of the complaint, the second respondent has not taken any steps to trace the detenue. Hence, he has filed this Habeas Corpus Petition.
2. We have heard the learned counsel appearing for the https://hcservices.ecourts.gov.in/hcservices/
petitioner and the learned Additional Public Prosecutor appearing for the State and we have also perused the records carefully.
3. Today, when the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that the second respondent has registered a complaint and are conducting investigation. It is revealed from the investigation that the detenue has eloped with the third respondent and she has not been abducted or detained illegally.
4. We are satisfied that there is no illegal detention of the detenue and the detenue has only eloped with the third respondent.
5. Hence, the petition is dismissed, however with a direction to the second respondent to take steps to expedite the investigation and trace the detenue.
