O R D E R

This Writ Petition has been filed under Article 226 of the Constitution of India, praying for to issue Writ of Mandamus directing the 3rd respondent herein to consider the representation of the petitioner dated 13.07.2021 and pass appropriate orders accordingly.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents as well as perused the material available on records.

Having considering the facts and circumstances of the case and the submissions of the learned counsel on either side, it is seen that if there is discrepancy in the patta No.1545 issued in favour of the petitioner, the 2nd respondent has passed order dated 31.05.2019 vide proceeding No.Mu.Mu.A5/378/2019 directing the 3rd respondent herein that based on the documents submitted by the petitioner and others landowners to undertake new sub division after merging the Survey Nos.292/2A1A, 2A1B, 2A1C, 1C1A, 1C1B 1C2 1C3, 2A3, 2A4, 2A5, 2A6, 292/3, 4 and 5 based on the copy of the document and FMB sketch. Since there is no action taken on the aforesaid proceedings, the petitioner herein has submitted a representation dated 13.07.

2021 to the 3rd respondent by Registered Post with acknowledgement requesting to take action as per the order of the 2nd respondent herein. Despite the receipt of the representation 13.07.2021 of the petitioner herein, the 3rd respondent have neither taken any action nor sent any reply on his representation so far. Hence, this Court without expressing any opinion with regard to the merits of the case, directs the 3rd respondent to consider the representation dated 13.07.2021 of the petitioner herein and pass appropriate orders within a period of four months from the date of receipt of copy of this order in accordance with law after perusing the revenue records.
