Crl.O.P.No.16580 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Kumar, who was arrested and remanded to judicial custody on 24.06.2023 for the offences punishable under Sections 4(1)(aa) read with Section 4(1-A) (ii) of TNP Act in Crime No.110 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has ben falsely implicated in this case. Petitioner is in Judicial Custody from 24.06.2023. Thus, he seeks bail to the petitioner.

3. The learned Additional Public Prosecutor submitted that, on 24.06.2023 at about 10.00.a.m., when the respondent police mounted surveillance near Melvilamuchi village, they found that, petitioner was found in possession of 55 litres of illicit arrack. He further submitted that, apart from this case, there are five similar previous cases pending against the petitioner. Out of five previous cases, two cases had been disposed and three cases are pending.

4. Considering the fact that petitioner is an habitual offendor and there are similar previous cases pending against him and that investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.
