The petitioner, who was arrested and remanded to judicial custody on 25.07.2022 for the offences punishable under Sections 392 and 397 of Indian Penal Code in Crime No.168 of 2022, seeks bail.

2. The case of the prosecution is that, the petitioner along with other accused waylaid the defacto complainant and robbed a sum of Rs.20,00,000/- at knife point and also attacked him with knife. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is a 60% disabled person and he has been falsely implicated in this case. That apart, the petitioner has been suffering incarceration from 25.07.2022. Hence, he prays for grant of bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. The learned Government Advocate (Criminal Side) appearing for the respondent would submit that, out of 20 lakhs, only 2,80,000/- has been recovered. He further submitted that there are two previous cases pending against the petitioner. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the gravity of the offence committed by the petitioner and also considering that the petitioner was arrested only on 27.06.2022 and that the remaining portion of the amount is not yet recovered, this Court is not inclined to grant bail to the petitioner.
