ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 328 of I.P.C r/w Section 7 and 20(1) of Cigarette and other Tobacco Product Act 2003, in Crime.No.1546 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that there are totally 3 accused in this case. It is alleged that the petitioner/A3 along with other accused were found in illegal possession of 68 bags of banned tobacco products worth Rs.5,24,000/- Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and is no way connected with the alleged offence. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that the petitioner was found in illegal possession of 68 bags of banned tobacco products worth Rs.5,24,000/- .Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also that the seized tobacco products were of huge quantity, this Court is not inclined to grant bail to the petitioner.
