ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Section 420 of I.P.C. in Cr.No.Not known of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is alleged to have borrowed loan for Rs.10 Lakhs at 2% interest per month from the defacto complainant after executing Rs.100/- stamp paper with promissory note conditions and thereafter cheated the defacto complainant.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. The learned counsel further submitted that the petitioner's husband took loan from the defacto complainant and on his behalf, the petitioner issued signed blank cheques which was thereafter manipulated and further submitted that the defacto complainant instead of approaching the competent civil forum, has lodged the criminal complaint, which is un-sustainable one. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Government Advocate submitted that based on the complaint lodged by the defacto complainant, a case in Crime No.42 of 2021 for the offence under Sections 406, 420 of I.P.C. read with Section 34 of I.P.C. has been registered by the respondent police and further submitted that investigation reveals that the cheated amount is more than Rs.28 Lakhs.

5.Considering the huge amount involved in the case and the gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 6.This criminal original petition is accordingly dismissed. -sd/- 01/11/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
