The appeal suit is filed challenging the judgment and decree dated 20.01.2017 passed in O.S. No. 28 of 2013 by the learned Principal District Judge, Chengalpattu.

Parties have arrived at a compromise and a memo of compromise signed by the respective parties and their counsel has been filed evidencing complete settlement. Though the memo of compromise has been filed in the C.M.P. to condone delay, it is submitted that the same may be recorded in the appeal suit.

Accordingly, the appeal suit stands disposed of in terms of the memo of compromise. 3.

Mr.M. Rajasekhar, learned counsel for the respondent submitted that the parties will not pursue E.P. No. 218 of 2017 and the same 2\4

is hereby recorded.

The memo of compromise shall form part of the decree. Parties are entitled to refund of court-fee as admissible under the Rules. No costs. Connected C.M.P. is closed.
