By consent of both parties, this writ petition is taken up for final disposal.
2. This writ petition is filed challenging the enquiry notice issued by the first respondent in Na.Ka.No.4654/A2/2019 dated 20.11.2020 and quash the same.
3.The learned counsel for the petitioner submitted that based on the complaint of the respondents 2 and 3 alleging that a fabricated document in Doc.No.4093 of 2019 was registered in favour of the fourth respondent, the impugned enquiry notice is issued.
4. Now, it is admitted by both sides that a partition suit in O.S.No.186 of 2015 is pending on the file of the District Munsif-cum-Judicial Magistrate, Perundurai.
5.Heard both sides and perused the materials placed on record.
6. Since, a suit is already pending before the Civil Court, let the parties 2/4
agitate their rights before the civil court. Such view of the matter, the impugned enquiry notice dated 20.11.2020 issued by the first respondent is set aside.
7. In view of the above, this writ petition stands allowed. No costs.
