Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to consider and take necessary action on the representation of the petitioner, dated 09.11.2020 by rectifying the Field Map Book(FMB) sketch of the land comprised in Survey No.43/11A and 11B of Devampattu Village, Ponneri Taluk, Tiruvallur District, pursuant to and also in the light of the sale deed, dated 28.08.1981, vide Document No.2346/1981, registered at Sub-Registrar Office, Ponneri.

ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus, directing the 2nd respondent to consider and take necessary action on the representation of the petitioner, dated 09.11.2020 by rectifying the Field Map Book(FMB) sketch of the land comprised in Survey No.43/11A and 11B of Devampattu

Village, Ponneri Taluk, Tiruvallur District, pursuant to and also in the light of the sale deed, dated 28.08.1981, vide Document No.2346/1981, registered at Sub-Registrar Office, Ponneri.

2.Mr.G.Rajesh, learned Government Advocate takes notice for the respondents.

3.The grievance of the petitioner is that in the FMB prepared, the property that belongs to the petitioner has been demarcated at the wrong spot, and he wants to have the property demarcated correctly, for which purpose, he has preferred a representation dated 09.11.2020 to respondents 2 and 3. 4.Heard both sides.

5.The second respondent/Tahsildar is now required to cause an enquiry into the matter after issuing due notice to all the parties who are likely to be affected by his act and after grating them a fair and effective hearing, to dispose of the representation of the petitioner through a speaking order, within a period of eight(8) weeks from today (05.01.2021). 6.The learned Government Advocate is required to communicate the operative portion of the order to the concerned official.
