Crl.O.P.No.16568 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Gopi @ Kishore, who was arrested and remanded to judicial custody on 13.06.2023 for the offences punishable under Sections 341, 323, 363 of IPC @ Sections 147, 148, 341, 342, 323, 324, 364 A and 302 of IPC in Crime No.109 of 2023 on the file of the respondent police, seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in this case. Petitioner is in Judicial Custody from 13.06.2023. Thus, he seeks bail to the petitioner.
3. In response, learned Government Advocate (Crl. Side) submitted that, there are totally nine accused in this case. Petitioner is the seventh accused. A1 and deceased had some monetary dispute. On 23.02.2023 at about 07.45.p.m., the deceased had food at A2B Restaurant, Koyambedu and he was about to leave the hotel. At that time, he was kidnapped by the accused. They had attacked the deceased with 1/3
iron rod and wooden log. Thereafter, they had taken him to kolapaakam garbage dump yard and there he was poured with petrol and set fire. As a result, he died. CCTV footage is also available to connect the petitioners in the crime. Investigation in this case is pending. Thus, he prays for dismissal of the petition.

Considering the nature of allegations made in the FIR and having regard to the fact that petitioner is the primarily responsible for kidnapping the deceased and subsequent causing of his death by pouring petrol and that investigation in this case is pending, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original petition is dismissed. 26.07.2023 Sma 2/3
